Terms and Conditions
Your purchase is governed by contract law, consumer protection laws, including consumer purchase law, right of withdrawal law, and e-commerce law. To the extent these laws are applicable, and if you are a consumer, they will take precedence over this Agreement.
1. General
The agreement consists of the information that Bag'in provides about the product and purchase in the order solution in the webshop (including information about the nature, quantity, quality, other characteristics, price and delivery terms of the goods), any direct correspondence between the parties (e.g. email) and these terms of sale ("the Agreement").
In case of conflict between the information that Bag'in has provided about the purchase in the order solution in the webshop, direct correspondence between the parties and the agreement, direct correspondence between the parties and the information provided in the order solution shall take precedence over the terms of sale, unless it conflicts with applicable legislation.
The agreement applies when you as a consumer ("you", "your" or "the customer") place an order via www.bagin.com ("the Website"). The agreement is entered into between you and Gardenstore ("Bag'in", "we" or "us").

You must have the authority to enter into binding contracts to order via the website. According to Swedish legislation, Bag'in does not accept credit purchases from persons under 18 years old. You hereby confirm that you have the authority to enter into a contract for purchase from the website.
Bag'in reserves the right to change this agreement from time to time if such changes are appropriate with regard to business operations. When changing the Agreement, we will notify you of relevant changes 14 days before the changes take effect. An updated version of the terms will always be available on the website and we therefore recommend that you check these regularly.
2. Intellectual Property Rights
All intellectual property rights, including copyright to images and content on the website, product design and layout, domain, trademarks etc. are owned by Bag'in. All use of the website and its content, including copying or storing all or parts of the content, for any purpose other than personal, non-commercial use is prohibited without Bag'in's permission.
3. Prices
The prices stated in the webshop are inclusive of VAT.
Information about the total costs you must pay, including all fees (value added tax, customs etc.) and delivery costs (shipping, postage, invoice fees, packaging etc.) as well as the breakdown of the individual parts of the total price is provided in the order solution before the order is placed. (Goods deliveries to Svalbard or Jan Mayen shall be sold without the addition of value added tax).
4. Product
Bag'in has the right to change prices, include additional fees and change product information, e.g. product images and sales, without notice. The available product images and information texts reflect the product as well as possible. We reserve the right to any errors that may occur on the website and cannot guarantee that all images reflect the product's exact appearance. Images may vary depending on the color settings on your computer. All images should only be seen as illustrations and do not guarantee correct and exact appearance and characteristics.
5. Agreement
The agreement is binding for both parties when your order has been received by Bag'in.
However, a party is not bound by the agreement if there has been a typographical error in the offer from Bag'in in the order solution in the webshop or in your order, and the other party realized or should have realized that there was such an error.
6. Order Confirmation
When Bag'in has received your order, we confirm the order without undue delay by sending you an order confirmation. You are encouraged to check that the order confirmation corresponds to the order regarding quantity, type of goods, price etc. If there is no correspondence between the order and the order confirmation, you should contact the seller as soon as possible.
7. Payment
We use Klarna as the provider of our checkout. This means that we may transfer your personal data in the form of contact and order information to Klarna when the checkout is loaded, so that Klarna can handle your purchase.

Please note that for payment methods where applicable (such as card and bank account), the amount will be reserved at the time of purchase and captured (charged) when the order is shipped.
8. Delivery etc.
Delivery of the goods from Bag'in to you takes place in the manner, at the place and at the time specified in the order solution in the webshop.
If the delivery time is not specified in the order solution, Bag'in shall deliver the goods to you within a reasonable time and no later than 30 days after the order was placed by the customer. If Bag'in is to ensure that the goods are sent to the customer, we are obliged to ensure that the goods are transported to the destination in an appropriate manner and on customary terms for such transport. The destination is with the customer unless otherwise specifically agreed between the parties.
9. Risk for the Goods
The risk for the goods passes to you when you take over the goods according to the agreement. If the delivery time has expired and you refuse to receive goods that have been made available to you according to the agreement, you still bear the risk of loss or damage due to the nature of the goods.
10. Right of Withdrawal
You can cancel the purchase in accordance with the provisions on right of withdrawal (7). Right of withdrawal means that you can return the goods to Bag'in without reason even if there is nothing wrong with them and even if they have not been delivered.
You must notify the seller about the use of the right of withdrawal within 14 days after receiving the goods, the prescribed information about the right of withdrawal and the withdrawal form. If you receive a withdrawal form and necessary information at a later time than upon delivery of the goods, the withdrawal period begins to run from the day you receive the withdrawal form and information. For the right of withdrawal to be respected, it is sufficient that you send a notification that you want to use your right of withdrawal before the time limit expires. In any case, the right of withdrawal expires 12 months after the end of the original 14-day time limit.
Notification of the use of the right of withdrawal should be in writing for evidential reasons (withdrawal form, email, fax or letter) and must contain information about how you want to return the goods to Bag'in.
When using the right of withdrawal, the goods must be returned to Bag'in within a reasonable time and no later than 14 days from the notification that you want to use the right of withdrawal.
Bag'in is obliged to refund the entire purchase price and delivery cost to you within 14 days from the day we receive the goods or pickup receipt or the goods are otherwise made available to us. You must pay the costs for the return shipment yourself. We may withhold payment until we have received the goods back or until you have provided documentation that the goods have been returned, or until whichever of these events occurs first.
You may examine the product before you regret your purchase. However, the goods must be able to be returned to us in approximately the same condition and quantity as when you received them. If possible, send the goods back to us in the original packaging. You are responsible for any decrease in value of the goods as a result of handling the goods other than what is necessary to determine their nature, characteristics and function.
11. Examination of the Goods
When you receive the goods, you should reasonably be able to check whether they are in accordance with the order, whether they have been damaged during transport or whether they otherwise have defects.
If the goods do not correspond to the order or have defects, you must notify Bag'in through a complaint, see clause 11 of the agreement.
12. Complaint of Defects and Time Limit for Notification in Case of Delays
Bag'in has a legal obligation to deliver goods in accordance with the agreement. If the goods have a defect, you must notify us of this within a reasonable time and no later than within two months after you discovered or should have discovered the defect. However, a complaint must be made within five years. The notification to Bag'in or the credit company should be in writing (email, phone, fax or letter).
To make a complaint, you send us an email to contact@bagin.com, where you describe the problem.
In case of delay, claims must be made to the seller within a reasonable time after the delivery time has expired and the goods have not been delivered.
If the goods are paid for with a credit card, you can also choose to complain and send claims directly to the credit card provider.
If the goods have a defect and this is not due to you or circumstances on your part, you may, according to the rules in consumer protection law chapter 6, depending on the circumstances, retain the purchase price, choose between having the goods restored and new delivery, demand price reduction, demand that the agreement be terminated and/or demand compensation from us.
13. Delay and Non-delivery – Buyer's Rights and Time Limit for Notification of Claims
If Bag'in does not deliver the goods or delivers them late in accordance with the agreement between the parties, and this is not due to you or circumstances on your part, you may, in accordance with the rules in chapter 5, under these circumstances withhold the purchase price, demand performance, terminate the agreement and/or demand compensation from Bag'in.
14. Liability
Any compensation is limited to your proven and documented financial loss. The compensation does not include losses as a result of personal injury or losses that may arise in your business operations.
Bag'in is exempt from liability and other penalties if the performance of the agreement is prevented, hindered or delayed due to circumstances beyond our control or force majeure, such as natural disasters, war, strikes etc.
15. Buyer's Rights in Case of Default by the Buyer
If you do not pay or fulfill other obligations according to the agreement or law, and this is not due to Bag'in or circumstances on our part, we may, according to the rules in consumer protection law chapter 9, under the circumstances withhold the goods, demand that the agreement be performed, demand that the agreement be terminated and demand compensation from you. We may also, under the circumstances, charge interest on late payment, collection fees and a reasonable fee for uncollected goods.
16. Warranty
The warranty period is 3 years from the date of purchase.
The warranty applies to the Bag'in product and not to products/goods or similar that Bag'in is used to protect or store.
To make a claim under this warranty, you are kindly requested to follow [the procedure for making claims, e.g. fill in the contact form, provide proof of warranty etc.]. The costs for the return are paid by Bag'in.
The warranty does not cover:
- Errors or damage as a result of inappropriate use or negligence
- Defects or damage as a result of unauthorized repair or modification
- Errors or damage caused by force majeure (natural disasters, fire, war etc.)
- Aesthetic changes that occur with normal wear and aging
If Bag'in cannot see any of the problems described above, the product will be returned to the customer. Note that in such cases you must pay for the repair/replacement, even if the warranty is still valid.
17. Conflict Resolution
The parties shall strive to resolve any disputes amicably. You can contact the consumer council for help in a possible dispute with the seller. If an amicable settlement is not reached after the consumer council has been consulted, the parties may request in writing that the consumer council refer the dispute to the committee for consumer disputes.
18. Applicable Legislation
This agreement is governed by Swedish law. Disputes should be resolved amicably as far as possible. Disputes that cannot be resolved amicably shall be decided by your general court, i.e. the court in your place of residence.
